Please note:

  • A small claims court plaintiff (person that files the claim against the other party) generally cannot file an appeal for an unfavorable small claims judgment. However, if the defendant filed a counter claim during the lawsuit, the plaintiff can appeal.
  • A defendant can always appeal an unfavorable small claims court judgment.
  • When a party appeals a small claims court judgment, the case moves to the Superior Court of California where the parties proceed from the beginning of the case. During the appeal, parties must prove their case by “preponderance  of the evidence.”

  • If the value of your claim is $10,000.00 or less, then you may elect to file your claim  in small claims court.
  • Small Claims Court may only hear cases of up to $10,000 in value for individuals. Corporations, partnerships, governmental entities and other legal entities cannot  claim more than $5,000.
  • Individuals may file unlimited claims for up to $2,500 each in a year. However, individuals may only file two claims a year that seek more than $2,500.
  • Lawyers are not allowed to represent parties in Small Claims Court. However, anyone is free to seek attorney advice in preparing trial.
